Terms of Use for the Website of The Hong Kong Foundation for the Prevention of Animal Abuse
Welcome to the official website of The Hong Kong Foundation for the Prevention of Animal Abuse (hereinafter referred to as “the Foundation”, “we”, “us” or “our”). These terms of use govern your access to and use of the website located at www.animalrescue.org.hk (the “Website”) and any content, functions and services made available through the Website.
By accessing or using the Website, you agree to be bound by these terms of use and our privacy policy. If you do not agree to these terms, you must not use the Website. We reserve the right to modify these terms at any time without prior notice. Your continued use of the Website following any such modification constitutes your acceptance of the revised terms.
The Website and all of its content, including but not limited to all text, images, pictures (including animal photographs and illustrations), logos, audio clips, video clips, data, software and their compilations (collectively, the “Content”), are the exclusive property of the Foundation, its licensors, or the animal welfare organizations, veterinary experts and volunteers featured on the Website. Such Content is protected by the Copyright Ordinance (Cap. 528 of the Laws of Hong Kong) and international copyright laws.
You may print or download pages from the Website for personal, non-commercial reference use, if you do not modify or remove any copyright or other proprietary notices. Any other use, including copying, modifying, distributing, transmitting, republishing, displaying or performing the Content, is strictly prohibited without the Foundation’s prior express written consent.
All trademarks, service marks, logos and trade names displayed on the Website are registered or unregistered trademarks of the Foundation or third parties. Nothing on the Website shall be construed as granting you any license or right to use any such marks.
You agree to use the Website only for lawful purposes and in a manner that respects animal welfare. You are prohibited from engaging in the following conduct:
⦁ Violating any applicable local, national or international laws or regulations, including those relating to animal protection and the prevention of cruelty to animals (such as the Prevention of Cruelty to Animals Ordinance (Cap. 169 of the Laws of Hong Kong)).
⦁ Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with any person or entity.
⦁ Uploading, posting or transmitting any content that is defamatory, obscene, indecent, vulgar, offensive, harassing, violent, hateful, inflammatory, or that promotes animal abuse, animal fighting, illegal hunting or other cruel acts.
⦁ Uploading or transmitting any virus, Trojan horse, worm, time bomb, keystroke logger, spyware, adware or any other malicious programme or code designed to harm the Website or any user’s computer.
⦁ Attempting to gain unauthorized access to, interfering with, damaging or disrupting any part of the Website, the server on which the Website is stored, or any server, computer or database connected to the Website.
⦁ Engaging in any data mining, scraping, or similar data gathering or extraction methods.
⦁ Using the Website to transmit or send unsolicited commercial communications (spam).
If the Website provides features that allow you to post, submit or upload content (e.g., animal adoption stories, reports of cruelty, forum posts, event submissions) (“User Content”), you grant the Foundation a non-exclusive, royalty-free, perpetual, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such User Content throughout the world in any media.
You represent and warrant that you own or control all rights in and to the User Content, and that such content does not infringe any third-party rights or contain any false or misleading allegations of animal cruelty. The Foundation reserves the right, but not the obligation, in its sole discretion to monitor, edit or remove any User Content. In particular, in the case of reports of animal cruelty, the Foundation may refer relevant information to the appropriate law enforcement or animal welfare authorities.
The Website may contain links to third-party websites or resources. Such links are provided for your convenience only. The Foundation has no control over the content of those websites and accepts no responsibility or liability for those websites or for any loss or damage that may arise from your use of them. The inclusion of any link does not imply endorsement by the Foundation of that website.
The Website and all content, materials, information and services provided or made available through the Website (including but not limited to animal care advice, veterinary opinions, behaviour training tips) are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.
To the fullest extent permitted by law, the Foundation disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. The Foundation does not warrant that: (a) the Website will be uninterrupted, secure or error-free; (b) any defects will be corrected; (c) the Website or its server are free of viruses or other harmful components; or (d) the information on the Website is accurate, complete, up-to-date or reliable. In particular, any animal health or behavioural information provided on the Website is for general reference only and is not a substitute for professional veterinary advice, diagnosis or treatment. You should consult a qualified veterinarian regarding any specific animal health issue.
To the maximum extent permitted by applicable law, in no event shall the Foundation, its directors, officers, members, employees or agents be liable for any direct, indirect, incidental, special, consequential or punitive damages (including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses, or any injury, illness or death of an animal) arising out of or in any way connected with your use of or inability to use the Website (including but not limited to reliance on animal care information on the Website, adoption matching results, or the outcome of cruelty reports).
You agree to defend, indemnify and hold harmless the Foundation, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs (including reasonable legal fees) resulting from any breach of these terms of use by you or any person accessing the Website through your internet connection, or any activity related to your account (including negligence or misconduct, such as posting false reports of animal cruelty).
The Foundation reserves the right, with or without notice, in its sole discretion to terminate your access to all or part of the Website for any reason, including but not limited to breach of these terms of use or use of the Website to promote, engage in or conceal animal abuse.
The Foundation is committed to preventing animal cruelty and promoting animal welfare. If you find any content or user behaviour on the Website that may violate the Prevention of Cruelty to Animals Ordinance or promote animal cruelty, please notify us immediately using the contact details in section 14. The Foundation will take appropriate action within reasonable limits, including removing the relevant content and/or reporting the matter to the Hong Kong Police or the Agriculture, Fisheries and Conservation Department.
These terms of use and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You irrevocably agree that the courts of Hong Kong shall have exclusive jurisdiction to settle any such dispute or claim.
If any provision of these terms of use is held to be unlawful, invalid or otherwise unenforceable, that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of the remaining provisions.
