Personal Information Collection Statement (hereinafter referred to as “this Statement”)

This Statement is issued to you by The Hong Kong Foundation for the Prevention of Animal Abuse (hereinafter referred to as “the Foundation”) in accordance with the provisions of the Personal Data (Privacy) Ordinance (Cap. 486) of the Hong Kong Special Administrative Region (hereinafter referred to as “the Ordinance”). The Foundation is committed to protecting the privacy and security of personal information and ensures that all collection, use, storage, transfer and disclosure of personal information strictly comply with the data protection principles and relevant requirements under the Ordinance.

This Statement applies to situations where the Foundation collects personal information from you in connection with various business operations and activities (including, but not limited to, donation processing, event registration, volunteer recruitment, subscription to information and follow-up of enquiries). When the Foundation collects personal information from you, it will provide this Statement to you, in an appropriate form and manner (for example, by displaying it on the same form or webpage used for collecting personal information, or in the form of this Statement), at or before the time of collection. This Statement sets out the purposes for which personal information is used, the nature of the obligation to provide the information, the consequences of failing to provide the required information, the classes of persons to whom the information may be transferred or disclosed, information concerning the use of the information for direct marketing (if applicable), and your rights to request access to and correction of your personal information.

1. Purposes of Collection of Personal Information

The Foundation collects and uses your personal information primarily for one or more of the following purposes directly related to the Foundation’s charitable and operational functions:

1.1 Processing Donations: To process your donations and other payments, and to issue donation receipts and related documents;
1.2 Event and Project Management: To process event and project registrations, enrolments and participation matters, including but not limited to animal welfare promotion activities, educational workshops, adoption days and fundraising events;
1.3 Volunteer Recruitment and Management: To process volunteer applications, registrations and related human resources management matters;
1.4 Communication and Follow-up: To communicate with you, respond to enquiries, and follow up on applications or requests submitted;
1.5 Administration and Record Keeping: To handle the Foundation’s general business operations and internal record keeping;
1.6 Statistics and Research: To compile statistical data, conduct surveys, analyses and research in order to optimise the Foundation’s services and operational efficiency;
1.7 Compliance with Legal Requirements: To fulfil any statutory requirements or legal obligations binding on the Foundation;
1.8 Other Directly Related Purposes: Other uses directly related to the above purposes.

2. Provision of Personal Information and Consequences of Failure to Provide

Except for information that is marked as mandatory on the relevant collection form, the provision of personal information by you to the Foundation is generally voluntary. However, if you fail to provide the mandatory personal information, or if the information provided is inaccurate or incomplete, the Foundation may be unable to process your application, registration, enquiry or provide you with the requested services.

3. Types of Personal Information Collected

The types of personal information collected by the Foundation (depending on the specific circumstances) include, but are not limited to, the following:

3.1 Personal Contact Information: Including name, telephone number, email address, postal address and fax number;
3.2 Donation and Financial Information: Including donation records, bank account details and credit card information;
3.3 Identity Verification Information: Including Hong Kong Identity Card number (where necessary and permitted by law) and other personal identification codes;
3.4 Business Information: Including company name and position (if applicable);
3.5 Other Voluntarily Provided Information: Including date of birth, age, gender and any other personal information you choose to provide;
3.6 Images and Audiovisual Information: Including photographs and videos provided by you to the Foundation (if applicable).

4. Transfer and Disclosure of Personal Information

The Foundation keeps your personal information confidential, but it may be transferred or disclosed to third parties in the following circumstances:
4.1 Service Providers and Contractors: To agents, contractors or third-party service providers who provide services to the Foundation such as administration, telecommunications, computing, data processing, mailing, printing, marketing support and research, provided that such persons are subject to duties of confidentiality and use the information only to the extent necessary for performing the required services;
4.2 Co‑organisers and Partners: To partner organisations, agents or other third parties who jointly organise fundraising, educational or related activities with the Foundation;
4.3 Legal and Regulatory Bodies: To statutory, governmental or regulatory bodies in order to comply with statutory requirements or legal obligations binding on the Foundation;
4.4 Other Circumstances Permitted by Law: To disclose in other circumstances permitted by the Ordinance or required by law.
Except for the above circumstances, the Foundation will not transfer or disclose your personal information to any third party without your prior consent.

5. Retention of Personal Information

The Foundation will retain your personal information for no longer than is necessary for the fulfilment of the original (or directly related) purposes for which it was collected. Different types of personal information may be retained for different periods depending on the purposes. When personal information is no longer required for such purposes, the Foundation will take all reasonable and practicable steps to delete or destroy the information.

6. Direct Marketing

6.1 The Foundation may use your name, telephone number, email address and postal address to send you direct marketing communications, including information, newsletters, fundraising appeals and event invitations relating to the Foundation and its activities.
6.2 In accordance with the Ordinance, before first using your personal information for direct marketing, the Foundation must obtain your consent (including your indication of no objection). The Foundation will, at or before the time of collecting your personal information, expressly inform you of the type of personal information to be used and the class of services or products to be marketed, and provide a channel through which you can indicate your consent or objection.
6.3 You may at any time (without charge) choose not to receive direct marketing communications. Whenever you receive a direct marketing communication from the Foundation, it will include an unsubscribe channel. You may also at any time notify the Foundation in writing to request that it stop using your personal information for direct marketing purposes.

7. Right of Access to and Correction of Personal Information

Under sections 18 and 22 of the Ordinance, you have the right to request access to and correction of your personal information held by the Foundation. Such requests must be made in writing using the “Data Access Request Form” (Form No. OPS003) prescribed by the Office of the Privacy Commissioner for Personal Data, Hong Kong. The Foundation may charge a reasonable administrative fee for processing a data access request. The Foundation will respond to the request within 40 days of its receipt.

The Foundation reserves the right to update or amend this Statement at any time. Any updates will be published on the Foundation’s website (http://www.animalrescue.org.hk). You should review this Statement regularly to stay informed of the latest personal information protection policies and practices.

This Statement is issued in both English and Chinese. In the event of any discrepancy between the English and Chinese versions, the English version shall prevail.
